This license governs use of the TinkyBrain v6 model weights, tokenizer,
configuration, and accompanying documentation (collectively, "the
Materials") published at https://huggingface.co/Hoodrobot/TinkyBrain-v6.

The Materials are made available under the Creative Commons
Attribution-NonCommercial-ShareAlike 4.0 International License
(CC BY-NC-SA 4.0), available at:

with the following ADDITIONAL TERMS that take precedence over any
conflicting language in the CC BY-NC-SA 4.0 license:


1. NON-COMMERCIAL USE PERMITTED
   You MAY use the Materials, free of charge, without further
   permission, for the following purposes:

     (a) personal, family, or household communication;
     (b) research and academic study, including publication;
     (c) classroom, school, or educational use, whether public,
         private, or homeschooled;
     (d) non-profit organizations operating in service of people
         with disabilities, communication needs, or accessibility
         goals;
     (e) speech-language pathologists and clinicians serving
         individual patients;
     (f) free and open-source projects whose primary purpose is
         accessibility for non-verbal, disabled, or limited-
         English-proficient users.


2. COMMERCIAL USE REQUIRES PERMISSION
   You MAY NOT, without prior written permission from the author:

     (a) use the Materials in any product or service for which
         you charge fees, license fees, subscription fees, or
         any other compensation;
     (b) incorporate the Materials into hardware, software, or
         services sold or licensed to third parties;
     (c) train derivative models on outputs of the Materials
         and use those derivatives commercially;
     (d) use the Materials to compete with TinkySpeak,
         TinkyTown, TinkyBrain, or any product or service
         offered by the author or his affiliated entities.

3. ATTRIBUTION
   In all permitted uses, you must:

     (a) retain this LICENSE file and the README.md unmodified;
     (b) credit "TinkyBrain v6 by Luke A. Kist" in any
         publication, product, or interface that uses the
         Materials;
     (c) link to https://huggingface.co/Hoodrobot/TinkyBrain-v6
         where reasonably possible.


4. SHARE-ALIKE
   If you distribute the Materials, modified or unmodified, you
   must distribute under this same license. You may not impose
   additional restrictions beyond those in this license.


5. NO WARRANTY
   The Materials are provided "AS IS" without warranty of any
   kind, express or implied. The author makes no guarantees
   regarding fitness for a particular purpose, accuracy of
   outputs, or absence of errors.


6. LIMITATION OF LIABILITY
   In no event shall the author be liable for any claim, damage,
   or other liability arising from the use of the Materials,
   including but not limited to use as a medical communication
   aid, emergency communication tool, or in any context where
   communication accuracy is critical to safety.

   The Materials are intended for general augmentative and
   alternative communication (AAC) use only. They are not a
   medical device. They are not a substitute for human
   communication, professional medical advice, emergency
   services, or licensed clinical interpretation.


7. RESPONSIBLE USE
   You may not use the Materials, or train any derivative
   thereof, for purposes that:

     (a) discriminate against, marginalize, or harm
         disabled, non-verbal, limited-English-proficient,
         elderly, or otherwise vulnerable populations;
     (b) generate misleading, fraudulent, or harmful
         content directed at the populations served by AAC
         technology;
     (c) violate applicable laws regarding the rights of
         persons with disabilities (including but not limited
         to the Americans with Disabilities Act in the United
         States, the Equality Act in the United Kingdom, or
         analogous legislation elsewhere).


8. TRADEMARK NOTICE
   "Tinky," "TinkyBrain," "TinkySpeak," "TinkyTown," and
   "Tinkyscan" are trademarks or trademark applications of
   Luke A. Kist. Nothing in this license grants permission
   to use these trademarks. Trademark rights are reserved
   separately.


9. SEVERABILITY
   If any provision of this license is held unenforceable, the
   remainder shall continue in full force and effect.


10. GOVERNING LAW
    This license is governed by the laws of the State of
    Connecticut, United States of America, without regard
    to conflict-of-laws principles.
