Preamble

This Hyper-Nix Restricted Open License (HROL-v2) is designed to promote the open use, modification, and recursive improvement of AI models while establishing strict behavioral guardrails against user data exploitation and unauthorized surveillance.

Definitions

"Model" refers to the machine learning model, including its weights, parameters, architecture, configuration files, and accompanying source code.

"Derivative Works" refers to any modifications, fine-tunes, adaptations, or new models substantially trained utilizing the Model, its weights, or synthetic data generated by the Model.

"User Data" refers to any prompts, chat logs, inputs, or personal information submitted by end-users to the Model during operation.

1. Grant of License & Permitted Uses

Permission is hereby granted, free of charge, to any person obtaining a copy of this Model and associated documentation files, to deal in the Model without restriction—including without limitation the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Model—subject to the conditions and restrictions outlined in Sections 2 and 3.

General Use: You may use the Model for personal, academic, or commercial purposes, including text generation, roleplay, reasoning tasks, and application integration.

Recursive Improvement & Synthetic Data: You are explicitly ALLOWED and encouraged to use the Model, its outputs, and user interactions (such as ratings, chat logs, and inputs) for the purposes of Reinforcement Learning from Human Feedback (RLHF), Direct Preference Optimization (DPO), synthetic data generation, embedding creation, or memory augmentation to improve this Model or create Derivative Works.

2. Conditions of Use

The license granted in Section 1 is subject to the following conditions:

Attribution: The above copyright notice and this permission notice shall be included in all copies or substantial portions of the Model.

Restriction Propagation: Any Derivative Works created from this Model must be released under terms that explicitly include and enforce the Prohibited Uses outlined in Section 3 of this license.

3. Prohibited Uses (Behavioral Restrictions)

The following use cases are STRICTLY PROHIBITED. By using, modifying, or distributing the Model, you agree not to use it, or allow others to use it, for:

Data Exploitation & Brokering: Selling, licensing, monetizing, or otherwise transferring raw User Data, chat logs, or personally identifiable information (PII) processed by this Model to third parties without the explicit, opt-in consent of the user.

Tracking & Surveillance: Using the Model or its outputs to identify, track, deanonymize, or build profiling dossiers on individuals without their explicit, informed, and legally valid consent.

Malicious Deception: Intentionally using the Model to generate targeted disinformation, facilitate social engineering, or generate non-consensual deepfake content intended to harm individuals.

4. Disclaimer of Warranty

THE MODEL IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE MODEL OR THE USE OR OTHER DEALINGS IN THE MODEL.
